These Terms govern purchases, services, installations, warranties, and use of BlindsFactory.ca. By using our website, approving a quotation or invoice, booking a measure, scheduling installation, or making any payment, you agree to these Terms, our Installation Policy (included below), and our Privacy Policy.

BlindsFactory.ca Terms & Conditions (Including Installation Policy)

1. Introduction

Welcome to BlindsFactory.ca (“Company”, “we”, “us”, “our”). These Terms apply to all website use, quotations, orders, custom products, deliveries, installations, warranty claims, and service visits. If you do not agree, you must not use our services.

2. General Website Use

By using this website, you agree that you will:

  • Use it only for lawful purposes
  • Not copy, scrape, hack, or misuse any content
  • Understand that descriptions, prices, images, and availability may change without notice
  • Understand we do not guarantee accuracy or completeness of website information

3. Products & Custom Orders

Most products are custom-made and made-to-measure. All custom orders are final sale, non-refundable, and non-exchangeable. Colours, fabrics, textures, and finishes may vary due to screen settings, lighting, dye lots, and manufacturing tolerances. Minor variations are not defects.

4. Measurements Responsibility

Measurement responsibility depends on who provides final sizes:

When final measurements are taken by BlindsFactory.ca technicians, accuracy is our responsibility.

Customer Measurements

When measurements are provided by the customer, full responsibility rests with the customer. Errors are not eligible for refund, replacement, or warranty coverage.

5. Pricing & Payments

  • All prices are in CAD and subject to applicable taxes
  • Prices may change without notice
  • We may correct pricing errors and cancel or adjust orders if needed
  • Deposits and payments for custom orders are non-refundable
  • Full payment may be required before production, delivery, or installation

6. Order Changes, Cancellations & Restocking

  • Once production has started, no changes or cancellations are permitted
  • Approved changes before production may result in additional fees and delays
  • Cancellation before production may be subject to administrative fees
  • Non-custom items may be returned only with written approval and may be subject to restocking and shipping fees
  • Wallpaper and specialty products may be treated as custom and final sale

7. Delivery, Delays & Force Majeure

  • Delivery and installation dates are estimates only
  • We are not responsible for delays caused by suppliers, manufacturers, carriers, customs, weather, strikes, shortages, or events beyond our control
  • Delays do not entitle the customer to refunds, discounts, or cancellations

8. Risk Transfer & Title

Risk of loss or damage transfers to the customer upon delivery or installation. We are not responsible for damage, theft, or loss after delivery or installation.

9. Installation Policy (Binding)

The following installation rules apply to all projects.

9.1 Measurements

  • Our measurements = our responsibility
  • Customer measurements = customer responsibility

9.2 Access & Conditions

Customer must provide safe, clear access and suitable structural conditions.

9.3 Structural Disclaimer

  • Drywall cracks, paint damage, tile damage
  • Hidden wiring, plumbing, framing
  • Pre-existing defects

9.4 Installation Team

All installations are performed by BlindsFactory.ca in-house technicians only. No subcontractors.

9.5 Service Call & Labour

  • $150 service call fee applies to all visits
  • Labour is not covered under warranty
  • Applies regardless of defect status

9.6 Electrical & Motors

We are not responsible for electrical limitations or future reprogramming.

9.7 Completion & Acceptance

Customer must inspect immediately. Issues after completion may result in service charges.

9.8 Delays & Rescheduling

Missed or unsafe appointments may result in additional fees.

9.9 Site Safety

Technicians may refuse work if conditions are unsafe. Additional visits may be charged.

9.10 Limitation of Liability

Liability limited to the cost of installation service only.

9.11 Modifications

Policy may be modified without notice.

10. Returns, Refunds & Warranty

Damaged or Defective Products

Must be reported within 7 days of delivery. We may repair or replace the defective component at our discretion.

Custom Orders

All custom products are final sale and non-refundable.

Warranty Coverage

  • Lifetime Limited Warranty covers manufacturing defects in fabrics and components only (excludes motors, accessories, electrical parts, misuse, and environmental damage)
  • Operational cords & fabrics covered for 7 years (normal wear excluded)
  • Somfy motors: 5 years
  • Other motors: 2 years (extendable for a fee)
  • Accessories (remotes, chargers, batteries, adapters, transformers, solar panels): no warranty
  • $150 service call fee applies to all service visits
  • Labour is not covered under any warranty (parts only)

Warranty Exclusions

  • Improper installation or misuse
  • Excessive heat, sunlight, moisture, pests, accidents
  • Normal wear, fading, discoloration
  • Cleaning damage or chemical exposure
  • Removal, reinstallation, or shipping costs

11. Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the total amount paid by the customer
  • We are not responsible for business losses, loss of profit, or loss of use

12. Electronic Acceptance & Binding Agreement

Placing an order, approving electronically, or paying by e-transfer, credit card, or deposit constitutes full legal acceptance of these Terms, the Installation Policy, and the Privacy Policy. No physical signature is required.

13. Photography & Marketing Consent

The customer grants BlindsFactory.ca a perpetual, royalty-free right to photograph or record completed installations for documentation, marketing, website, and social media use. No personal identifying information will be disclosed without consent.

14. Health, Safety, Pets & Children

The customer must ensure a safe work environment, including:

  • Securing pets
  • Supervising children
  • Clearing access and hazards

We are not responsible for injuries, damages, or delays caused by unsafe conditions, pets, or children. The customer agrees to indemnify and hold BlindsFactory.ca harmless from related claims.

15. Right to Refuse Service

We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion.

17. Modification of Terms

We may modify these Terms at any time without prior notice. Continued use constitutes acceptance of the most current version.

18. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Disputes shall be resolved in Ontario courts or arbitration located in Ontario.
